Note. In the event of any discrepancy between the Spanish version and the English translation of these terms, the Spanish version shall prevail.
Acceptance of Terms
Torodoro S.L. ("Torodoro") is the company that owns and operates the online platform torodoro.es (hereinafter, the "Platform"). By accessing or using this Platform, the user (hereinafter, the "User") acknowledges and fully accepts these Terms of Use. If the User does not agree with these conditions, they must refrain from using the Platform. Use of the Platform also implies acceptance of our Privacy Policy, in compliance with current personal data protection regulations. The Platform is intended for individuals 18 years of age or older. If a minor wishes to use the Platform’s services, they must have permission and supervision from a parent or legal guardian.
Description of the Platform
The Platform provides Users with an online directory of local businesses, along with a system for booking appointments or services with those businesses. Through this Platform, Users can search for information about local establishments and professionals and conveniently arrange service bookings electronically. Torodoro operates as an intermediary facilitating contact between Users and the listed businesses. Services booked through the Platform are provided directly by the respective independent businesses or professionals, and Torodoro is not a party to the contract for the provision of those services.
Use of the Platform
The User agrees to use the Platform appropriately and lawfully, solely for its intended purposes. In particular, it is strictly prohibited to engage in conduct such as:
Use the Platform for any purpose or effect that is unlawful, illegal, or contrary to good faith and public order.
Publish or transmit content that is defamatory, obscene, offensive, violent, discriminatory, or that infringes the rights of third parties (including intellectual property rights or data protection rights).
Cause damage to the physical or logical systems of the Platform, its providers, or third parties, for example by introducing computer viruses, malware, or other harmful code.
Attempt to access other users’ accounts, computer systems, or networks connected to the Platform without authorization, or to extract data or information from the Platform in an automated way (e.g., through bots, scrapers or similar methods).
Impersonate any person or misrepresent your affiliation with any person or entity when using the Platform.
Reproduce, duplicate, copy, distribute, or exploit any part of the Platform or its content for commercial purposes without prior written consent from Torodoro.
Violation of the above rules may result in Torodoro suspending or terminating the offending User’s account, as well as taking any appropriate legal action.
User Registration and Account
Basic access to the Platform is free and does not require registration. However, to use certain features (for example, making service bookings or managing a business listing), it may be necessary to create a user account. Registration is voluntary and free of charge, and it requires providing truthful, up-to-date information (such as name, email address, etc.) and setting a secure password. The User agrees that all information provided during registration and use of the Platform is accurate, complete, and kept up to date. If Torodoro detects or suspects that the information provided is false, inaccurate, or incomplete, it may suspend or cancel the User’s account. The User is responsible for maintaining the confidentiality of their login credentials (username and password) and for all activities that occur under their account. In case of any unauthorized access or misuse of the account, the User must immediately notify Torodoro. User accounts are personal and non-transferable. Registering more than one account per person is not permitted, nor is transferring or sharing an account with others without authorization. Torodoro reserves the right to suspend or delete duplicate, fraudulent, or otherwise non-compliant accounts. Torodoro may, at its discretion, suspend or permanently terminate a User’s account in the event of a breach of these terms or any suspicious activity that could compromise the security of the Platform or other users. The User may also request deletion of their account at any time through the channels provided on the Platform.
Third-Party Content and External Links
The Platform may include content provided by third parties, such as information about local businesses, user reviews, or other materials. While Torodoro strives to moderate and maintain the quality of published information, it does not guarantee the accuracy, completeness, or timeliness of such third-party content. Each business is responsible for the truthfulness and legality of the information it provides about its services, and each User is responsible for any content they may publish (e.g., reviews or comments). Torodoro assumes no liability for any damage or harm that may arise from incorrect, incomplete, or unlawful information supplied by third parties on the Platform. Additionally, the Platform may contain links or references to external websites operated by third parties (for example, websites of listed businesses or others). These links are provided solely for the User’s convenience. Torodoro has no control over such external sites or their content, and thus it is not responsible for them, nor does the inclusion of a link imply any endorsement or approval of the linked content. The User accesses third-party websites at their own risk and should review and accept the terms of use and privacy policies of those external sites.
Intellectual Property
All elements and content included on the Platform (including, among others, texts, descriptions, images, logos, designs, user interface, source code and software) are the property of Torodoro S.L. or its licensors, and are protected by intellectual and industrial property laws. The User’s access to and use of the Platform does not imply any transfer or waiver of such rights, nor does it grant the User any license or rights over the same beyond what is strictly necessary for the proper use of the Platform. Users are permitted to access, view, and print content from the Platform solely for their personal, non-commercial use related to the purposes of the Platform. The reproduction, distribution, public communication, transformation, or any other form of exploitation, in whole or in part, of the Platform’s content is prohibited without the prior express written authorization of Torodoro or the respective rights holders. Any content that a User or a business provides or posts on the Platform (for example, business profile data, reviews, comments, photographs, logos, etc.) remains the property of its owner. However, by providing such content, the User or business grants Torodoro a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and communicate that content on the Platform and in activities related to providing the service. The User or business represents that they possess all necessary rights to the content they provide and guarantees that such content does not infringe upon any third-party rights or violate any laws. If any User or third party believes that any content available on the Platform violates their own or others’ intellectual or industrial property rights, they may notify Torodoro by sending a notice to info@torodoro.es. Upon verifying such notification, Torodoro reserves the right to remove the allegedly infringing content and take appropriate measures in accordance with applicable law.
Data Protection and Privacy
Torodoro S.L. complies with Regulation (EU) 2016/679 (General Data Protection Regulation - GDPR) and applicable Spanish legislation on personal data protection. All personal data collected through the Platform will be processed in accordance with our Privacy Policy, which the User can consult on the website for detailed information. The personal data that the User provides (for example, when registering or making a booking) will be used solely for the purpose of operating and providing the Platform’s services and, where applicable, will be shared with the relevant third parties (for example, the business with which a reservation is made) to facilitate the requested service. Torodoro will not share the User’s personal data with third parties except as necessary to fulfill the User’s requests or to comply with legal obligations. Torodoro implements appropriate technical and organizational measures to protect personal data against unauthorized access, alteration, or loss. The User is entitled to exercise their rights of access, rectification, deletion, opposition, restriction of processing, and data portability, in accordance with the law. These rights can be exercised under the terms established by current regulations, typically by contacting Torodoro via the email provided in the Privacy Policy or through the contact information provided in these terms.
Limitation of Liability
Use of the Platform is at the User’s own risk. To the extent permitted by law, Torodoro shall not be liable for any damage or harm arising from the use of the Platform. In particular, Torodoro assumes no responsibility for:
Interruptions, errors, or malfunctions in the operational performance of the Platform or the availability of its services.
Lack of availability or accessibility of the Platform at certain times, or its slow or suboptimal performance.
The accuracy, truthfulness, or completeness of content published on the Platform by third parties, including information provided by listed businesses.
The quality or fulfillment of services offered by the businesses listed on the Platform, as those services are the exclusive responsibility of the respective businesses.
Damage to the User’s computer systems (e.g., from viruses or malware) or loss of data that might occur as a result of accessing or using the Platform.
Any indirect, special or consequential damages or losses (including loss of profit, loss of business, or loss of opportunities) arising from the use or inability to use the Platform.
In any event, Torodoro will only be liable for those damages directly attributable to it in cases of willful misconduct or gross negligence, and only up to the maximum limit established by law. Nothing in these Terms of Use shall limit or exclude any non-waivable rights that the User may have as a consumer under applicable law.
Changes to Terms
Torodoro reserves the right to update or modify these Terms of Use at any time, for example to adapt them to legislative, technical, or operational changes to the Platform. Any modification will be effective from the time it is published on the Platform. Users are advised to review these Terms of Use regularly. Continued use of the Platform after the new conditions come into effect will constitute acceptance of those modifications by the User. In the event that any provision of these Terms of Use is declared null, void or unenforceable, that circumstance will not affect the validity of the remaining provisions. The affected part will be interpreted in the manner that most closely reflects the original intent of the parties, and if that is not possible, it will be deemed omitted, with the remaining conditions remaining in full force.
Governing Law and Jurisdiction
These Terms of Use shall be governed and construed in accordance with the law of Spain. For any dispute or claim arising from the interpretation or enforcement of these terms, and with express waiver of any other jurisdiction that might apply, the parties submit to the jurisdiction of the courts of Spain. The foregoing is without prejudice to any special jurisdiction mandated by applicable consumer protection regulations in favor of the User.
