Terms of Service
Note. In the event of any discrepancy between the Spanish version and the English translation of these terms, the Spanish version shall prevail.
Acceptance of Terms of Service
These Terms of Service govern the use of the services provided by Torodoro S.L. through the Platform, and are supplementary to the general Terms of Use of the Platform. By using the Platform’s features for booking appointments or services (hereinafter, the "Services"), the User acknowledges that they have read and agree to these Terms of Service. If the User does not agree with these conditions, they should not use the Services offered on the Platform.
The ability to book services through the Platform is intended only for individuals 18 years of age or older. If a minor wishes to make a booking, it must be done with the consent and supervision of their parent or legal guardian.
Description of the Service
Through the Platform, Torodoro offers a system that allows Users to book appointments or services with the local businesses listed in its directory. The User can search for providers by category or location, view their profiles and availability, and submit a booking request for a desired date and time. The Platform forwards this request to the selected business, which is responsible for accepting, confirming, or proposing an alternative based on its availability.
Once the business confirms the requested booking, a direct agreement is established between the User and that business for the provision of the service on the agreed date and terms. Torodoro simply facilitates the contact and booking management and does not participate in the actual performance of the service contracted.
Use of the Service and User Account
In order to use the Platform’s booking system, the User must have an active user account and be logged in. The User agrees to provide and maintain truthful and complete information when using the Services, including the details necessary to manage the booking (for example, name, contact information, and any relevant details of the request).
When submitting a booking request, the User should follow the instructions provided by the Platform, filling in all required fields with accurate information. Any communication or data the User enters on the Platform in the context of a booking must be lawful, relevant to the requested service, and respectful to the parties involved.
Bookings and User Obligations
When making a booking through the Platform, the User agrees to:
Submit only genuine booking requests, with the intent to attend the appointment and use the service at the agreed date and time.
Adhere to the scheduled times and terms for the appointment; if unable to attend, cancel the booking as far in advance as possible, either through the function provided on the Platform (if available) or by contacting the business directly.
Respect any cancellation policies, service rules, or other specific conditions communicated by the business, including any prerequisite requirements necessary for the provision of the service.
Treat the business’s staff with respect and courtesy, and use the contracted service in an appropriate manner according to its intended purpose.
Pay the price of the service provided in accordance with the conditions established by the business, understanding that Torodoro is not involved in the billing or collection process for those services.
Repeated failures by the User to comply with these obligations – such as regularly missing appointments without notice or making fraudulent bookings – may result in the suspension or cancellation of the User’s account and the inability to continue using the Platform’s booking system.
Torodoro’s Role and Relationship with Businesses
Torodoro acts solely as a technical intermediary between the User and the service-providing businesses. By facilitating a booking through the Platform, the User understands and agrees that the contract for the provision of the booked service is established exclusively between the User and the corresponding business. Torodoro is not a party to that contract and does not participate in the execution of the service, which is the sole responsibility of the business.
The businesses listed on the Platform are independent entities and are not part of Torodoro nor do they act on Torodoro’s behalf. Torodoro does not endorse or guarantee the quality, suitability, legality, or availability of the services offered by those businesses. Any claim, dispute, or dissatisfaction related to the service provided by a business must be resolved between the User and the provider business, without prejudice to the User informing Torodoro of the situation.
Torodoro will not be liable to the User for cancellations, changes, failure to perform, or any act or omission by the business in connection with the provision of the booked service. In particular, Torodoro does not guarantee that the business will ultimately provide the service under the agreed conditions, even though the Platform will endeavor to transmit requests and confirmations effectively. Any legal obligations regarding warranty, indemnification, or liability arising from the service rest with the provider business in accordance with applicable regulations.
Suspension or Termination of Service
Torodoro reserves the right to temporarily suspend the Platform’s booking features for technical reasons (maintenance, improvements or updates) or for security reasons. When possible, Torodoro will inform Users about any significant interruption of the service.
Likewise, Torodoro may cancel or restrict a User’s access to the booking service (for example, by blocking the ability to make new bookings) in the event of a breach of these Terms of Service or the Terms of Use, or if deemed necessary to protect the integrity of the Platform, the businesses, or other users. Such suspension or cancellation may be carried out immediately and without prior notice in cases of serious misuse or improper conduct by the User.
Torodoro also reserves the right to permanently terminate the booking Services offered on the Platform. In the event of a complete shutdown of the Platform’s operations or its intermediary services, Torodoro will communicate this to Users with as much advance notice as reasonably possible.
Limitation of Liability
The User understands and agrees that use of the Services is at their own risk. To the extent permitted by law, Torodoro provides the Services “as is” without any express or implied warranties, and excludes any liability arising from their use, except for that which cannot be lawfully excluded. In particular, and without limitation, Torodoro will not be liable for:
Errors or delays in the transmission of booking requests or messages, or the inability to process a request due to technical, communication, or Platform operational failures.
The temporary unavailability of the Services, whether due to scheduled maintenance or unforeseen outages.
Any discrepancy between the information displayed on the Platform about a service or business and the actual experience the User obtains when receiving the service from the business.
Any damage or loss arising from a business’s cancellation of a booking or inability to provide the service for reasons not attributable to Torodoro.
Any indirect or consequential damages or lost profits the User may suffer in connection with the use of the Platform or the booking Services.
In any case, Torodoro’s aggregate liability to the User for any matter arising from the use of the Services will be limited to the maximum extent permitted by applicable law. Nothing in these Terms of Service shall affect the User’s non-waivable legal rights as a consumer.
Additionally, the disclaimers and liability limitations provided in the Platform’s general Terms of Use shall apply to any matters not expressly regulated in this document.
Data Protection
Use of the booking Services involves the processing of the User’s personal data, such as contact information and details related to the requested appointment. Torodoro will process this data in accordance with the data protection regulations in force and its Privacy Policy, solely for the purpose of facilitating the interaction with the business and managing the requested booking.
By making a booking, the User consents to Torodoro sharing with the corresponding business their contact details and only those request details that are strictly necessary for the business to provide the booked service. Torodoro requires businesses to use such personal data exclusively for the purposes of managing the booking and delivering the service, in accordance with applicable data protection law.
For more information about the processing of personal data in the context of the Services, the User should refer to Torodoro’s Privacy Policy, which also outlines the procedures for exercising their rights (access, rectification, deletion, etc.).
Changes to Terms of Service
Torodoro reserves the right to modify or update these Terms of Service at any time, for example to adapt them to changes in the Services, applicable laws, or business conditions. Any modification will take effect from the time it is published on the Platform. Users are encouraged to review the current Terms of Service periodically. Continued use of the Services after the new conditions are published will constitute acceptance of them by the User.
If any provision of these Terms of Service is declared null or unenforceable, such a declaration will not affect the validity of the remaining provisions, which will remain in full force and effect. The affected provision will be interpreted in the manner that most closely reflects the original intent of the parties, and if necessary, replaced by another provision that fulfills that intent to the maximum extent permitted.
Governing Law and Jurisdiction
These Terms of Service are governed by the laws of Spain. For any dispute that may arise from their interpretation or application, and with express waiver of any other jurisdiction, the parties submit to the jurisdiction of the courts of Spain, except to the extent that consumer protection regulations mandate a different specific jurisdiction, in which case that legal provision will prevail.
